It happens every October -- the tsunami of pink washes across the western world. Everyday items debut in limited edition models blushing shades of Pepto Bismol, pink trinkets multiply like tribbles, the world?s landmarks become awash in rose lights, and pink ribbons dominate the logo landscape like an invasive species.

Welcome to National Breast Cancer Awareness Month.

While dedicating an entire month to breast cancer awareness is clearly an act to be applauded -- and we do, whole-heartedly -- it hasn?t all been a bed of healthy roses.

The most notable entity behind Pink October is the non-profit foundation, Susan G. Komen for the Cure (Komen). Komen raises a load of money (to the tune of $35 million a year) from its many dozens of cause marketing partnerships, which allows corporations to use the pink ribbon and Komen branding to promote their wares in return for compensation to the foundation.

Which would be great if there hadn?t been so many deeply questionable partnerships made and products promoted in the name of pink.

Like, the nifty Smith and Wesson M&P9 JG pistol engraved with the Awareness Ribbon and packaged with pink grip inserts -- packing for the cure? Or the Promise Me perfume, replete with potentially carcinogenic ingredients. Or the pink-ribboned Vodka for Her. (We'll just assume they didn't get the memo listing the studies that link alcohol consumption and breast cancer.) And then there was the KFC Buckets for the Cure campaign. Yes, tortured chickens and obesity-inducing junk food for the cure!

But pink Grinches we are not, so as the month is drawing to a close we thought we?d take a look at some of the products from the all-things-pink category of goods that are actually pretty great for their non-toxic clean bills of health. Here are eight we found that get our green stamp of pink approval.

It used to be the AIA and other form contracts contained a mandatory arbitration clause. A few years ago, the AIA removed its arbitration clause and the default is now litigation unless the parties specifically select arbitration. However, when negotiating a contract, whether for construction or other real estate matters, the question arises, how to handle disputes.

There are pros and cons to both.? It depends on what's important to the parties.? Here are some factors to consider--

• Privacy - If privacy is important to you, arbitration is the better option. Litigation in court is very public. However, if privacy matters more to one party than the other, then being able to threaten a public court battle can be strategically useful to the other party.
• Costs - Arbitration requires higher filing fees and the parties pay for the arbitrator(s) time.??If the dispute is small, arbitration is less desirable.?
• Speed? - Some say arbitration is faster. Other litigators have told me that arbitration is no longer quicker and cheaper than litigation. Know how quickly arbitration can proceed versus your local court system before agreeing to one approach over the other. One advantage to arbitration in a large, complex case is the ability of an arbitrator to structure the procedures to the specific needs of a case and otherwise move the case efficiently. That may help contain costs in the long run; 'may'--no guarantee.
• Expertise - In arbitration, you can select arbitrator(s) that have some expertise in the subject matter of your contract. Having an arbitrator with the appropriate expertise can help in obtaining a well-informed decision.?In litigation, you are randomly assigned a judge whose biggest skill may be in winning elections. Some jurisdictions are moving to create?specialized business/commercial courts to help improve the court system on handling these cases.
• Procedural - In litigation, there are rules of?civil procedure that address the process and rules of discovery that address how you obtain discover information to be used in trial.? Depending on how you set the parameters for arbitration, you don't automatically have a right to use discovery rules to obtain information. If you have access to all the information and evidence that you need for the hearing, then it may not matters. However, if in order to prove your side you need information that is in the possession of the other side, then you may not have a way to discover that information in the arbitration process unless your agreement provides for it.
• Inclusion of necessary parties - Arbitration is by agreement only. If there is some likelihood that dispute resolution would require the involvement of several parties subject to different contracts, then the dispute resolution provision in each agreement would need to be essentially the same or you would need their agreement to participate.?

There is no one-size-fits-all answer. It depends on what makes sense in a given situation. As a transactional lawyer (i.e., I 'do deals' and never set foot in a court room,) I often find that the best solution is frequently to just work out a reasonable business solution and avoid both.

Disability Trends: Oldest Old Improving, Boomers Doing Worse

ANN ARBOR--(ENEWSPF)--October 29, 2012. ?The oldest old are doing better and those approaching late life are doing worse, but Americans between the ages of 65 and 84 are experiencing about the same level of disabilities as they did at the start of the 21st century.

Those are the key findings a new study of trends in late-life activity limitations that harmonizes the findings of five independent national surveys of more than 40,000 Americans.

The study, funded by the National Institute on Aging, was published online this week by the peer-reviewed journal Demography. Conducted by a team of researchers from several U.S. universities and think tanks, the study is the most comprehensive analysis to date of how well older Americans are able to carry out daily living tasks independently.

"A new pattern has emerged by age," said University of Michigan demographer Vicki Freedman, lead author of the study. "We found essentially flat trends for those between 65 and 84 years of age, sandwiched between increases among the population ages 55 to 64 and decreases among those ages 85 and older."

The new findings are noteworthy since they differ from earlier trends. From about the mid-1980s through 1999, the level of disabilities decreased steadily for the older population as a whole, according to Freedman, but over the last decade that trend has flattened.

"We were surprised to find that baby boomers aren't doing better," she said. "Their level of disability is still low compared to older Americans, but it was a full percentage point higher?five instead of four percent?compared to people of that same age 10 years ago.

"That may not seem like much of an increase, but, in fact, it represents about 365,000 more people who are having difficulty or who are unable to carry out basic personal care activities and activities central to living independently. This trend will be important to watch down the road because of the impact it may have on America's families and on public health care programs."

Among the activities assessed in the analysis were everyday tasks such as shopping, preparing meals, managing money, making phone calls, bathing, dressing and walking.

While the study did not assess the reasons for these increases, Freedman notes that others have found that rising rates of obesity and attendant health risks among the young old could account for some of the increase.

The reasons behind the continuing decrease in disabilities among Americans 85 and older also remain unclear, she says.

"Previously, we have found improvements in a wide variety of health conditions, including heart condition, musculoskeletal conditions and vision impairments," Freedman said. "The latter was linked to increases in cataract surgery. More widespread use of assistive technology and environmental changes that allow people to function independently much longer may also be at work."

Freedman and colleagues are continuing to monitor these trends, through the Disability Trends Network at the Michigan Center for the Demography of Aging, part of the U-M Institute for Social Research. Funding for the research was provided by a grant from the National Institute on Aging (P30-AG012846).

It might not be the best day to announce a new light bulb, but at least Philips' hue isn't just any old light bulb.

It is a light bulb that you can control with your iPhone, iPad, or Android phone. Yes, with an app, you can not only turn on and off the light when you are away from home, but you can also customize the color of the light.

How does it all work? The starter kit, which starts at $199, comes with a smart bridge, a gadget that plugs into your home's WiFi router. That bridge connects to the LED bulb and then the 600 lumen LED bulb connects to the hue app on your phone. The bulbs screw into your existing fittings, just like any normal light bulb.

The secret sauce is really in the app though. That's where you can control the light with some pretty advanced features, including matching the color of the light to a color on any photo; the bulbs supports any color on the RGB spectrum, which equals 16 million different colors.

You can also say goodbye to those old light bulb timers; you can set the light to turn on and off at a specific time and even wake you up with a "gentle wake up" setting. Lastly, you can control up to 50 bulbs from the single app.

Other companies have announced WiFi equipped light bulbs, but Philips is the first to bring it to market for consumers. It is based on ZigBee Light Link standard, which other companies such as Sylvania and GE are also working with.

The $199 hue starter kit, which contains three light bulbs and the bridge, goes on sale on Oct. 30 at Apple stores. The rub? Additional bulbs cost $59, while the average LED light bulb costs much less - about $10 on Amazon. Hey, no one ever said replacing the light switch with your phone was going to be cheap!

Parkinson managed to get the better of America?s Patrick Gudauskas in the seventh heat to confirm his place in the fourth round, bringing the contention for the event title to a premature end for his rival in the process.

The eighth heat saw Buchan competing with Brazil?s Alejo Muniz for survival, with the former standing victorious once the dust settled whereas the latter got eliminated from the competition.

The shifty waves breaking a the primary event site during the initial rounds of the competition put the skills and experience of the elite ASP surfers to an ultimate test, keeping them from cutting loose despite offering some pretty juicy barrels.

There was plenty of entertainment on offer for the huge crowd that had come all the way to La Graviere to experience the action up-close, whereas the global audience continued to catch every second of the action live through high-quality webcast.

Parkinson, who had been in top-notch form since the start of the season, had plenty of reason to eye a big result at the latest elite tour, since it could take him all the way to the top of the ASP World Championship Tour rankings.

After getting off to an ordinary start at Quiksilver Pro France, getting relegated to Round 2 after tasting defeat in Round 1, the Australian powerhouse bounced back strongly to make his way into the third round, where he had to pass through Gudauskas to make the Round 4 cut.

As the battle got underway, the 31-year-old Parkinson got down to business right away, earning a 7.00 off his first wave in the opening minutes of the heat.

Keeping the momentum going, he went on to add a 3.07 to his account, thus moving to a heat-total of 10.07 points.

Gudauskas apparently struggled to find rhythm in the demanding conditions on hand. Despite a desperate effort, he only managed to score a 2.77 and 3.83 off his best-two waves, thus finishing with an insufficient heat-total of 6.60 points, thus conceding a comfortable victory to Parkinson.

?They?re really tricky conditions,? Parkinson said. ?I saw Dane (Reynolds) get a 10 and I wanted to try and find one like that, but I figured every other heat has been quite low scoring. So if you get a 7, it?s like a 9, and you get a 3 or a 4, the rest of the heat I just played defense trying to keep him off anything. It was a tricky heat with not a lot of waves, and a lot of paddling. It doesn?t matter in these conditions who you draw ? anyone can beat anybody.?

The eighth heat turned out to be a thrilling affair, with Buchan getting the better of his rival in the final minutes of the one-on-one bout.

The Australian surfer opened his account with a 2.93-poing ride, allowing Muniz to grab the lead with a 5.17-point wave a few minutes later.

As the heat progressed, the Brazilian surfer added another 2.53 points to his account, consequently moving to a heat-total of 7.70 points.

Requiring a decent score to challenge his rival?s position, Buchan was able to find a 7.83-point ride in the dying minutes of the heat, moving to a heat-total of 10.76 points and thus claiming top honours.

Obama balancing storm response with campaigning

WASHINGTON (AP) ? President Barack Obama has spent months trying to balance his re-election bid with running the government.

Now, just when his campaign needs him the most, with little more than a week before the election, his official job is beckoning.

Republican challenger Mitt Romney, too, faces questions about how to conduct his campaign as a superstorm charges toward the East Coast. But as president, it's Obama who oversees the federal government's preparations for the looming storm and it's Obama who will bear the responsibility for any missteps.

With that in mind, Obama scrapped campaign events Monday night and Tuesday morning. He planned to return to the White House late Monday to monitor the storm and the government's response.

"This is an example, yet again, of the president having to put his responsibilities as commander in chief and as leader of the country first, while at the same time he pursues his responsibilities as a candidate for re-election," Josh Earnest, a White House spokesman, told reporters traveling with Obama to a campaign event Saturday in New Hampshire.

Still, ripping up Obama's strategically planned travel schedule was something his Chicago-based campaign was loath to do unless absolutely necessary.

In the tight race, the candidates have few opportunities left to blitz through the most competitive states, trying to build momentum and make a final pitch to undecided voters.

The president's handling of the storm could sway those late-breaking voters. If Obama is perceived as a strong leader who shows command in a crisis, some undecided voters may be compelled to back the president. But a botched response or a sense that he's putting politics over public safety could weaken his support at a point in the race where there's little chance to reverse course.

"I think that the president of the United States is the commander in chief. The American people look to him, and I'm sure he will conduct himself and play his leadership role in a fine fashion. So I would imagine that might help him a little bit," said Arizona Sen. John McCain, who lost to Obama in 2008.

"But I'm not sure it will affect votes. People have been exposed to this very long campaign," he said on CBS' "Face the Nation."

Obama advisers say they've learned the lessons from President George W. Bush's widely criticized response to Hurricane Katrina. Bush was seen as ineffective and out of touch, and his presidency never recovered.

That's why Obama's team has moved quickly throughout the year to avoid the impression that the president was shirking his responsibilities, even as the campaign ramped up.

When separate crises struck Colorado this summer ? destructive wildfires and a mass shooting at a movie theater ? Obama hastily arranged trips to meet with victims and their families. When a hurricane barreled through the Gulf Coast ahead of the Democratic Convention, the president added a stop in New Orleans to his preconvention itinerary.

But those decisions were far easier than what's facing Obama's team. Back then, there was time to add or reschedule trips. Now, with just nine days until Election Day, time is a precious commodity and canceling trips may mean never having the chance to make them up.

Hurricane Sandy was expected to hit the East Coast late Monday, then combine with two winter weather systems as it moves inland, creating a hybrid superstorm. At least four battleground states are likely to be hit: New Hampshire, North Carolina, Ohio and Virginia.

Obama plans to spend every day between now and Nov. 6 on the road in most of those states and others, though his schedule does call for him to be back in Washington some nights.

In canceling Obama's event Monday in Virginia, aides also considered the optics of urging thousands of people to venture out to a political rally in the midst of a raging storm.

Still, it was clear Obama's team was working hard to ensure that the president could keep campaigning as long as possible before he was needed back in Washington.

His departure for Florida, where he'll hold an event with Bill Clinton, was moved up from Monday morning to Sunday night in order to get ahead of the storm. Even though Monday's late event in Virginia was scrapped, Obama and Clinton planned to squeeze in an evening rally in Youngstown, Ohio, before the president was to return to the White House.

Romney canceled three events in Virginia on Sunday and planned to spend the day campaigning with running mate Paul Ryan in Ohio.

If bad weather keeps people in hard-hit battleground states from going to the polls, it could mess up the campaigns' carefully crafted get-out-the-vote efforts.

Jennifer Psaki, Obama's campaign spokeswoman, said the Democratic ticket was urging people to vote early when they can, especially if it helps them get to the polls before the storm.

"Safety comes first," she said. "And that's the case with early voting as well."

Northeast hunkers down ahead of hurricane

NEW YORK (AP) ? A fast-strengthening Hurricane Sandy churned north Monday, raking ghost-town cities along the Northeast corridor with rain and wind gusts. Subways and schools were closed across the region of 50 million people, the floor of the New York Stock Exchange was deserted, and thousands fled inland to await the storm's fury.

The monster hurricane was expected to make a westward lurch and aim for New Jersey, blowing ashore Monday night and combining with two other weather systems ? a wintry storm from the west and cold air rushing in from the Arctic ? to create an epic superstorm.

Authorities warned that New York City and Long Island could get the worst of the storm surge ? an 11-foot wall of seawater that could swamp lower Manhattan, flood the subways and cripple the underground network of electrical and communications lines that are vital to the nation's financial capital.

Because of Sandy's vast reach, with tropical storm-force winds extending almost 500 miles from its center, other major cities across the Northeast ? Washington, Baltimore, Philadelphia and Boston ? also prepared for the worst.

"The days ahead are going to be very difficult," Maryland Gov. Martin O'Malley said. "There will be people who die and are killed in this storm."

By late morning, the storm had strengthened to 90 mph and had already knocked out power to tens of thousands of people. Sandy was about 200 miles southeast of Atlantic City, N.J., where the emptied-out streets were mostly under water and where an old section of the historic boardwalk broke up and washed away.

Authorities moved to close the Holland Tunnel, which connects New York and New Jersey, and a tunnel between Manhattan and Brooklyn. Street grates above the New York subway were boarded up, but officials worried that seawater would seep in and damage the electrical switches.

Millions of people in the storm's path stayed home from work. Subways, buses and trains shut down, and more than 7,000 flights in and out of the East were canceled, snarling travel around the globe. Hundreds of thousands of people were under orders to flee the coast, including 375,000 in lower Manhattan and other parts of New York City, but authorities warned that the time to get out was short or already past.

Sheila Gladden evacuated her home in Philadelphia's flood-prone Eastwick neighborhood and headed to a hotel.

"I'm not going through this again," said Gladden, who had 5 1/2 feet of water in her home after Hurricane Floyd in 1999.

"I think this one's going to do us in," said Mark Palazzolo, who boarded up his bait-and-tackle shop in Point Pleasant Beach, N.J., with the same wood he used in past storms, crossing out the names of Hurricanes Isaac and Irene and spray-painting "Sandy" next to them.

"I got a call from a friend of mine from Florida last night who said, 'Mark, get out! If it's not the storm, it'll be the aftermath. People are going to be fighting in the streets over gasoline and food.'"

President Barack Obama declared emergencies in Massachusetts, Connecticut, Rhode Island, New York, New Jersey and Pennsylvania, authorizing federal relief work to begin well ahead of time. He promised the government would "respond big and respond fast" after the storm hits.

"My message to the governors as well as to the mayors is anything they need, we will be there, and we will cut through red tape," Obama said. "We are not going to get bogged down with a lot of rules."

Sandy, a Category 1 hurricane, was blamed for 65 deaths in the Caribbean before it began traveling northward, parallel to the Eastern Seaboard. As of 11 a.m., it was moving at 18 mph, with hurricane-force winds extending an extraordinary 175 miles from its center.

Forecasters said the combined Frankenstorm could bring close to a foot of rain in places, a potentially lethal storm surge of 4 to 11 feet across much of the region, and punishing winds that could cause widespread power outages that last for days. Up to 3 feet of snow was forecast for the West Virginia mountains.

About 90 miles off Cape Hatteras, N.C., the Coast Guard rescued 14 crew members by helicopter from a replica of the 18th-century tall ship made famous in the movie "Mutiny on the Bounty." The Coast Guard searched for two other crew members.

The rescued had donned survival suits and life jackets and boarded two lifeboats after the ship began taking on water. They were plucked from 18-foot seas just before sunrise.

O'Malley, the Maryland governor, said a fishing pier in the beach resort of Ocean City, not far from a popular boardwalk and amusement park, was "half-gone." The area had been ordered evacuated on Sunday.

Water was already a foot deep on the streets of Lindenhurst, N.Y., along the southern edge of Long Island, and the canals around the island's Great South Bay were bulging two hours before high tide. Gale-force winds blew overnight over coastal North Carolina, southeastern Virginia, the Delmarva Peninsula and coastal New Jersey.

In the morning, water was already splashing over the seawalls at the southern tip of Manhattan and had matched the levels seen during Hurricane Irene in August 2011. Still, people were out jogging, walking their dogs and even taking children out in strollers amid gusts of wind.

"We're high up enough, so I'm not worried about flooding," said Mark Vial, who was pushing his 2-year-old daughter, Maziyar, in a stroller outside their building, where they live on the 15th floor. "There's plenty of food. We'll be OK."

The major American stock exchanges closed for the day, the first unplanned shutdown since the Sept. 11 attacks in 2001. The floor of the NYSE, typically bustling with traders on a Monday morning, fell within the city's mandatory evacuation zone. The United Nations canceled all meetings at its New York headquarters.

New York called off school on both Monday and Tuesday for the city's 1.1 million students, and the more than 5 million people who depend on its transit network every day were left without a way to get around.

"If you don't evacuate, you are not only endangering your life, you are also endangering the lives of the first responders who are going in to rescue you," Mayor Michael Bloomberg warned. "This is a serious and dangerous storm."

New Jersey Gov. Chris Christie was typically blunt: "Don't be stupid. Get out."

The storm bore down barely a week before the presidential election. Wary of being seen as putting political pursuits ahead of public safety, Obama and Republican nominee Mitt Romney reshuffled their campaign plans.

In Virginia, one of the most competitive states, election officials eased absentee voting requirements for those affected by the storm. Three other closely contested states, New Hampshire, North Carolina and Ohio, were within Sandy's reach. Early voting was canceled Monday in Maryland and Washington, D.C., both reliably Democratic.

Craig Fugate, chief of the Federal Emergency Management Agency, said FEMA teams were deployed from North Carolina to Maine and as far inland as West Virginia, bringing generators and basic supplies that will be needed in the storm's aftermath.

"I have not been around long enough to see a hurricane forecast with a snow advisory in it," Fugate told NBC's "Today" show.
